Loan Modification & Loss Mitigation

Are you facing foreclosure or repossession?
If you are struggling with a home or car loan that has become impossible to pay, or if you need a break from payment, then maybe you need modification of your loan.  Have you received foreclosure notices, or other legal notices threatening your home or car?  We understand how frightening that can be, and we want you to know that in most cases we can help!  The fact is, the bank doesn’t really want your home or car.  The bank just wants to be paid, no more no less.  And quite often, the bank can be satisfied with a lower monthly payment.

Can you afford a reasonable monthly payment?
In most cases, our clients keep their homes and cars, even when filing for bankruptcy and even when facing foreclosure proceedings.  We have years of experience in dealing with mortgage lenders, and we know how to reach a compromise that works for everybody.  We can get your payments reduced while keeping your lender happy.

How does it work?
If you can afford to keep your mortgage payments current after bankruptcy, most lenders will agree to modify your loan, and then accept continued payments.  That process is called a “reaffirmation” of your loan.  That simply means that you agree to continue to be bound to your mortgage, and will continue making regular payments as originally agreed.  If you are unable to keep current on your mortgage payments, a loan modification may be possible.  This is where we renegotiate your mortgage with your lender, to bring your monthly payments down to a level you can afford, so you can stay in your home.  Most banks and lenders have loss mitigation departments that will work with attorneys.

Can’t I do this myself?
If you’ve ever struggled to reach a live human at your mortgage lender’s office, you already know the hurdles you’re in for.  We have years of experience in dealing with lenders, their language, their scare tactics and their obstacles.  Dealing with loan modification and loss mitigation is difficult.  In order to protect your rights in your property, you should consult with an attorney.
